Cesare Beccaria meant a couple of things when he said that the punishment should fit the crime. First he believed that the severity of the punishment should be the same as the severity of harm the crime caused. Next he thought that the punishment should also be serious enough to outweigh the pleasure obtained from the crime. Finally he believed that the punishment should be certain and swift to deter crime.

The first state prison was the Walnut Street Jail in Philadelphia. It was converted from a simple holding cell to a prison where offenders could be sentenced for their crime in 1790. In this prison the inmates were kept in solitary cells to study religion, reflect on their misdeeds, and perform handicraft work. These were the events of their day-to-day life while in confinement.

The difference between the deprivation and importation models is how an inmate is socialized into the prison system. The deprivation model suggests that an inmate is socialized into the current inmate society, which arises in response to the prison environment. The importation model suggests that an inmate is socialized from experiences they had outside prison. Basically deprivation suggests a prisoner acts like others in the prison and importation suggests that a prisoner will act like they did when they were outside the prison.

There are many conditions that can make a prison violate the Eighth Amendment. A few examples of violations are lack of ventilation, lack of drinkable water, exposure to sewage and flooding, sleeping on the floor, lack of fire safety, and unsanitary food. All of these conditions and many other are defined as cruel and unusual punishment and are unconstitutional.

The four types of victimization in prison are physical, economic, psychological, and social. Physical is a type of victimization that involves things of a sexual nature. Economic victimization is when inmates exchange goods and services that are contraband. Psychological victimization is when an inmate is manipulated through mind games like if an inmate knows something sensitive about another inmate and threatens to tell it to the other inmates. Social victimization is when prejudice and discrimination are used against an inmate because of some social characteristic that another inmate has.
