Research on the appropriate employment laws was done based on the client’s business, location and company size. A memorandum was tailor fitted to each our clients; with the most significant employment laws they need to be concerned with going forward.
Small Business Discussion
The small business client is Bradley Stonefield with Landslide Limousine. Mr. Stonefield’s goal is to employ 25 staff members within the first years of business. The main principles discussed were the Fair Labor Standards Act (FLSA), Occupational Safety and Health Act (OSHA), Uniformed Services Employment and Reemployment Rights Act (USERRA) and Employee Polygraph Protection Act (EPPA). These all apply to Bradley Stonefield’s business based on the type of the business, location and estimated size of the company. The Employee Polygraph and Protection Act (EPPA) is particularly important during the hiring process, although it also protects hired employees. Due to the nature of Mr. Stonefield’s company, he may want to do a further investigation of employees. Limousine drivers often have the responsibility of driving key people. It is important to know he may ask an interviewing employee to take a lie detector test, but if they refuse he cannot discriminate against their decision. Even though this will require consent, Mr. Stonefield should consider conducting background checks on all potential employees.
