Facts: In 1933 the Supreme Court took the case of James S. Funk who violated the eighteen amendments. The eighteen amendments in other words were known as the Prohibition Amendment where the transportation or exportation of alcohol was prohibited.
Procedure: Petitioner convicted at the trail level but he raised and objection stating that his wife should have been permitted to testify in his favor. Petitioner appealed to the U.S.S.C on Constitutional grounds.
Issue: Whether in a criminal case, in a federal court, a wife is competent to testify in favor of her husband. Her competency to testify against him was not involved.
