NewCorp has not retained counsel and use our knowledge to serve as an associate. The responsibilities are to advise and recommend courses of action to manage multiple scenarios covering legal meeting. As council will analyze each situation to provide management with associated legal principles, potential liability concerns, and courses of action. Last week the faculty has received three scenarios and management wants a substantive collaborative effort within a week.

Legal Case Two
NewCorp has a legal duty to its employees to ensure they provide a comfortable working environment in which their employees are not subjected to discrimination, and hostility based on the decisions they make, education level, gender, race, ethnicity, religion, nationality and creed. NewCorp have to ensure that their employees do not feel oppressed and if they do, they should communicate using channels where employees can report their complaints without fear of reprisal.

Potential Liability
NewCorp is subject to the liability of a sexual harassment and gender discrimination claim. Since Sam is an employee of NewCorp, Paula can sue New Corp for these injustices because it happened at the work environment. Sams sexual advances toward Paula create a hostile work environment. Sexual harassment is defined as sexually charged conduct that is offensive and creates a hostile work environment. This conduct includes verbal and non-verbal behaviors (Cheeseman, 2011). Sexual harassment is a violation of Title VII of the civil rights act. Gender discrimination is another liability that New Corp may face. Paula can file this claim because her transfer is denied based on the claim by Sam that she is a woman who is likely to get pregnant. Because of this fact, she should not work at the wire coating department because the chemicals used in wire coating could harm a fetus during the early stages of life (University of Phoenix, 2011).

Considering this fact may be true, this is an option that Paula should do for them. Paula should have the opportunity to transfer to any department, provided it meets the requirements and is available. No one should be denied the opportunity because she is a woman. It is clear that Sam is using his position to control it. This is a way where we see a hostile work environment. The Department of Labor (DOL) administers and enforces more than one hundred eighty federal laws that apply to conflicts of dismissal. The dismissal is not prohibited in Puerto Rico, an exception may occur when dismissal is against specific laws such as Law 100 and 80, among others. Paula can file a complaint with the Equality of Employment Opportunity Commission (EEOC) or any other entity providing advocacy services for these cases.
