They stated that their 8th Amendment was violated when they were paddled, beat with brass knuckles, and hit with belts. But due to little proof the court favor the school system, Justice Lewis Powell stated that the eighth amendment didnt apply to students. But he did agree with the students that “they possessed a liberty interest in avoiding the physical force and restraint of corporal punishment, and found that this interest was adequately protected by the safeguards existing in state law.” The three safeguards were: First one requires that the teacher discuss situations with the principal before inflicting corporal punishment. Second one states that the teachers could become liable for any civil damages that are unreasonable under the circumstances. And lastly, the teachers can be convicted for crime of assault and battery for physically harming students. So with the safeguard rules and regulations the teachers Eighth and Fourteenth Amendment is upheld.

Corporal punishment is commonly used to try to punish someone for doing something wrong. When a parent smacks their child on the bottom as a result from misbehaving, the child quickly learns that there will be consequences for their actions. Physical punishment should be administered to correct a behavioral problem because when you unchallenged a childs misbehaving you will never gain control at home or in school. What society fails to realize is that in order for a teacher to teach successfully she must have control over her class. And if theres a child who constantly acts out just because he has no home training then the other children are affected by it. Not all children are ADHD or even ADD, they just need guidance that their parent fail to provide.

Many of my own clients have the exact same problem. I’ve seen it with the kids I’m dealing with and they’re still doing so now.

Some parents would say to their kids that you know you’re an adult that may get an “ad-psychiatricity” diagnosis and not think to ask a professional if they know of anyone who’s done that at all. Why, for instance, does a counselor know I’m an ADD child and not think of me having any problems and never ask for help because of my ADD? And if parents have the same thoughts as many of those kids, why does it take so much more to help someone who is already an ADD kid than to offer their services on the internet?
