All people have civil rights and if they are violated people get punished for their crimes. The punishment could be simple for example some time in prison, or it could be very serious like death penalty. Death penalty is also known as capital punishment, and it is used for more serious crimes like murder, or killing someone like a police officer and the Supreme Court has also ruled that the death penalty can only be imposed for murder, and not for rape.
As of April 1, 2008, the Death Penalty was authorized by 37 states, the Federal Government, and the U.S. Military. Those jurisdictions without the Death Penalty include 13 states and the District of Columbia. (Alaska, Hawaii, Iowa, Maine, Massachusetts, Michigan, Minnesota, New Jersey, North Dakota, Rhode Island, Vermont, West Virginia, and Wisconsin). Now only 35 of the 50 states enforce the death penalty. The other 15 states support a life sentence without parole. Now the current law for death penalty is Unconstitutional because it conflicts with eight amendment which states that excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted. From 1977 through 2009 1,188 people were executed in US by capital punishment, and you could see thats a big number. And of course theres allot of social conditions involved, for example some of them are Race, religion, and Age many people think that. The public policy issue is that should capital punishment be constitutional or unconstitutional, and many people argue about it. And those arguments are called the pros and cons. The pros are arguments that are want the Capital punishment to be used and cons are arguments that are against Capital punishment, they dont want it to be used. Some of the Pros arguments are, it sends the wrong message for example it says why kill people who kill people to show killing is wrong. Another Pros argument is that theres a possibility that innocent person could be put to death. And finally last Pros argument that capital punishment shouldnt be used because it creates sympathy for the monstrous perpetrators of the crimes. And of course theres always Cons arguments why capital punishment should be legal and used. One of them is that justice is better served because people will fear the punishment for the crime. Another argument that is for it is that the death penalty gives closure to the victims families who have suffered so much. Therefore you could see that there are a lot of pros and cons, arguments why it should or should not be constitutional. I think is that it depends on situation, whether the person should be put to death, because there are other punishment that could be hurting to for example life imprisonment, its
