5 Major Concerns – Union and the Employer
In this case against the Union and the employer, 5 major concerns were brought up by the Union.
The union claimed that the employer had repeatedly interrogated employees about the creation of union. Next the employer or its representative had threatened employees with deprivation of benefits if the union was to be elected to represent the employees. Also, the employer threatened the employees over refusal of revealing identities of the employees who attended union meeting. Moreover, the employer informed the employee that they knew that the employee has joined the union. Lastly, the employer tried to bribe the employees by providing certain medical benefits in lieu of then not supporting the union.
The above claims made by the union are in accordance to the unfair practices observed by the employer where the employer tries to discourage union formation. At the time of the employment, Larry Melton, was a maintenance supervisor and he interacted mostly with the employees, therefore he was the management’s representative for these employees. Larry Melton’s actions can be deemed interfering since he persuaded various employees to reveal information about union activities as well as threatening them on not to join the union. Also on the day Leo Nord replaced Larry Melton, Also the company offered new benefit plan with additional coverage. All these events indicate that the employer tried to seek knowledge of the union activities and offer employees plans, which would encourage employees to boycott labor union.
On the contrary, the company claimed that it was unaware about the calls made by Larry Melton to its employees. Also, offering additional benefits plans were the part of company’s annual review of benefits program and had nothing to do with influencing the employees.
