Abusing the ADA
The Americans with Disabilities Act (ADA) is a great tool for helping out the disabled people in America. The ADA enforces strict rules on building accessibility requirements so that handicap people can become more independent. Over time the ADA has been bastardized into sheer uselessness by handicapped people abusing their power to create ridiculous lawsuits and unwanted trouble. These ADA abusers are creating tension among small and large businesses affected by these ridiculous lawsuits.
The ADA was signed into law by President Bush on July 26, 1990. The ADA helps out disabled people by requiring certain small and large business to make there facilities more handicap accessible. The ADA requires businesses to provide things like Braille signage, and bathroom accessibility along with many other regulations that improve the mobilization and participation among handicap people. The ADA is a great way for us to help out disabled people in need of assistance. ADA abusers should be ashamed for using the ADA to create ludicrous lawsuits for personal gain.
Although the ADA is a great way to help the disabled people of America, there should not be any exception for those handicap people trying to create ridiculous lawsuits against everyday businesses. These ADA abusers are creating lawsuits over petty issues like toilets being one half inch closer to the wall than it’s supposed to be, and doorways and hallways begin one inch too small. ADA abusers are making bad impressions for the honest handicaps that have overcome their disabilities threw hard work and determination. ADA abusers get their settlements by misleading the jury into felling sorry for there unfortunate disability.
One ADA abuser is a man by the name of Jarek Molski. Mr. Molski has over 500 lawsuits filed against businesses in California, mostly small, family owned businesses. He recently sued a restaurant named The Hitching Post. His unreasonable lawsuit asked for $4000/day. Mr. Molski sued because there toilet is one half inch closer to the wall than it was supposed to be, a doorway was one inch too small and a counter was a few inches too high. ADA abusers like Molski are relentless and are destroying the ADA for people using it properly to their advantage. Luckily, The Hitching Post state claims were dismissed leaving only the Federal ADA claims, which Molski later on dismissed because they had made the adequate repairs. Those repairs did not come easy to The Hitching Post, it cost them $60,765.97 in the past year and a half. Mr. Molski is a coward and does nothing but find places to sue over ADA compliance issues. According to Ken McCalip “the plaintiff (Molski) made $3 million in Southern California prior to moving to the Central California Coast to file more than 30 suits” McCalip. People like Molski are a direct threat to any business with ADA compliances issues.
Jim Sanford is another ADA abuser. Sanford has filed 121 ADA lawsuits in Sacramento California. He has tried to sue companies such as McDonalds, Carls Jr., Marie Calendars, RadioShack, Starbucks, Home Depot and Taco Bell. He clams he is suing for his civil rights begin violated as a disabled person. These clams are a waste of time and money for the everyday hard working Americans. Restaurant owner and lawsuit defendant Skip Mustafa says, “Apparently, this guy has a lot of lawsuits pending, and hes just making money for himself”. Just like Molski, Sanford is trying to use the ADA compliance to wrongfully
