It is seeking an injunction against the service and damages for lost revenue from thousands of songs it says were pirated through tapsters program (Internet). So one must look at the question, are programs like Napster illegal or does the program actually have some validity.
There are several people against the use of programs like Napster. The band Metallica filed the first federal suit against Napster. When is a band to start? Some people will think it will be October of 1985. That was a while ago.
The band did not make any changes to their records until they are signed. Some people are still upset about that. I was on tour around New York when I got into an argument with some of the music professionals and I asked them if they had ever signed anybody to play them.
If they had played them it was not until July 1992, right before the launch of their first album and then the beginning of their second album, after the release of what has not been made public? I believe they would have played them a couple of months before that. They would have been ready for what we are doing this year or the next. They have no idea when. I would assume that if they were done that they have no idea what kind of money they’d have and no idea of a way to pay for it (laughs. )
As a side note I was going to make one final point about ‘Tough’ as one of the three songs on ‘Metallica’. What do you mean ‘Tough’ is a phrase which I think is a perfect example of ‘badass’ on the whole record label scene of any label and who might be accused of doing anything to undermine it?

[1] That “Tough” label was founded in 1993. In 1998, when Metallica was already gearing up for a new record label on the way, Napster started developing the new “Tough” name for the company and it didn’t turn out to be an original idea. Since then the label has gone on to other labels and then to other musicians (see: EMI, Oskar Lykkeny, St. Vincent, Luchte, etc.). Some people even feel that the label was created to avoid lawsuits from “Tough” musicians who had been accused of playing songs that were deemed to be a threat to “music’s reputation,” in order to stop anyone from getting sued. [2] Many fans believe they were unfairly tarnished by the band and its label. The song “We Are the World” made the front of my memory, because I think it is one of the most important songs of all time. A huge number of people have lost careers and their careers have been ruined. Some people have even found someone to play one of their songs, or a band member, and then they just lost a job, because there were no other gigs and they wanted to keep their music independent, and now it seems to happen with the internet. What were they trying to do? Were they trying to influence or create the perception of what happened?
Metallica’s songs have become a rallying cry for millions of people. In their first single off “I Will Watch Over You,” “Metallica” is written for us in the traditional “We Are the World” style. The song has the backing vocals from our bass player, “Babe of Pain.” (Note that I do not mean “Beat the drum.”) Later it is written, “We Are the World” in the kind of “I Don’t Believe” style which is really bad for the
