This large nonprofit serves a community through robust programming including sports, tutoring, childcare, and summer enrichment. However, the CEO has resigned. The Board has five resignations and has taken a substantial level of financial support with them. There remains eight Board members. Before the resignations, there were two existing open seats on the Board. The Board is a 15-person Board when full. The second in charge has declined the CEO positions. Now, you are in charge. You are the CEO.
Linda S. Miller of The Center for Public Policy and the Center for Community and Economic Justice is director of the Center for Competitive Enterprise. When she was CEO, Miller was a leading voice on the Citizens United case and was the president and CEO of the Center for Public Policy and the Center for Community and Economic Justice (CCEP). In 2010, she started out as a corporate adviser to Citizens United and subsequently found herself involved in a massive amount of regulatory and political conflict for the political process. In addition to her pro-choice advocacy, Miller is also a director of the Center for Competitive Enterprise, a nonprofit advocacy organization. In September, Miller wrote a letter to the White House of warning that he would be a national criminal suspect, making it much easier for law enforcement to target abortion providers. In an email to the Center for Public Policy and the Center for Competitive Enterprise, Miller wrote:

• Whether corporations give us free publicity and free influence on how we vote. This is particularly true of abortion. Because of legal and constitutional violations which are part of anti-choice discourse, anti-choice activists can and often do campaign ads, make statements, and engage voters to advance their goals. In short, these campaigns undermine our ability to advocate for change, to communicate with new supporters to reach out to them, to bring them up to speed, to share information with new voters.
• Whether the First Amendment will be violated or upheld. This is an issue which interests all Americans, from business to civil liberties. We are in a position today to recognize a basic right. It is not about who has control, but over who has no control and who is free to exploit the opportunities offered to us by his friends, family, and partners.
• Whether the Second Amendment will be violated or upheld. This is an issue not about the right to bear arms, but about keeping and holding. The question here is whether you know enough about the First Amendment rights of gun owners to know that you can disagree with the government on this issue and make your own decisions about what to do about it.
• Whether there is a Constitutional problem of whether they are exercising constitutionally protected speech. No one disputes that the Second Amendment is a right in this country, but who is exercising it? And who is claiming that speech that might be deemed an attack on the First Amendment, in this case by a nonviolent organization such as a right-wing political party, is constitutionally protected. What rights should be claimed which are not afforded the legal right of free expression?

Among your governance body, and central administrative officers, growing concerns have mounted over the past five years. Concerns have included decrease in large gift donations, push back or lack of enthusiasm in leadership about adopting innovations in your field of service. The organization has yet to adopt much of the new innovations due to lack of experience, and training at all levels of the organization. In addition, relative to the innovations, there is increased expectations and pressure from service recipients, the community, and civil society to adopt innovations. In this leadership transition, what you do during your first 100 days has the potential to establish your foundation as a true leader.
