Cyber-crime is crimes conducted by the Internet or some other computer network. It is a new type of crime with the developing of technology. Hackers can hack into other’s computer or network to steal the confidential information. Cyber theft can steal other’s personal information so that he can use other’s financial resources. When the police find out someone is committing a cyber-crime, it is challenging to give them the Miranda Warning online. I think the post or tweet can be a confession but it can not be used in courts to testify according to the Fifth Amendment. In the Miranda v. Arizona, a man named Miranda was accused by kidnapping and raping a 18 years old woman. He was arrested by police without telling his rights provided by the Fifth Amendment. According to the Fifth Amendment of the Constitution, “No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a grand jury, except in cases arising in the land or naval forces, or in the militia, when in actual service in time of war or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.” Therefore, even though Miranda testified himself, he later told the American Civil Liberties Union that he was not informed his right so that he didn’t know he could wait there for a lawyer and said nothing. As the result, whenever a police arrest a suspect, he has to state the Miranda warning: “You have the right to remain silent. Anything you say can and will be used against you in a court of law. You have the right to talk to a lawyer and have him present while you are questioned. If you cannot afford to hire a lawyer, one will be appointed to represent you before questioning, if you wish one.”
