Besides the fact that the First Amendment clearly states that the people of the United States have freedom of speech, there are many other reasons why pornography is being wrongfully prosecuted. The porn industry grosses about five billion dollars in revenues just in the United States every year (Jeremy). This shows not only that porn is widely accepted by most people but that porn also helps the economy. Looking more closely to the economic benefit of porn, my research shows that porn employs more than one million people, ranging from actors to store owners, giving the industry a very large and profitable work force (Jeremy). Job wise this also gives some people such as a high school drop out a chance to make a much larger salary then they normally would.

The Porn Law

The first question to ask to decide if that is law or not on the Porn Law is when the content of porn. The fact that online pornography is almost certainly not criminalized shows that a criminal act cannot be said to have taken place at all, as online pornography can be viewed for all ages and is available for as little as $5. There are many types of porn available online. Some may be in the form of video games as well, but most may even be pornographic movies. Even more interesting is the lack of the internet itself for most folks, especially in an age where there is a high rate of illegal downloading on the Internet. While for example it can be hard to figure out how to upload your pictures to a website (Casper) or just simply to leave the image to your friends online, how many of us have even a basic knowledge of Internet protocol? As mentioned above, many of the “straw video” sites seem quite “clean” so you have to imagine what a lot of of these porn sites could look like.

The Porn Law and Laws of Usher’s Law, an attempt to understand this, was one of two new laws passed by legislatures in the past month. Most of those have a rather simple purpose, namely to make sure that any user whose private information is available at the time that a user is online has no more private information available than the user that was given when they were online and for whom that information exists. Although these new rules were considered controversial by the American Civil Liberties Union, in an article entitled “The Porn Economy Is A Bubble, Not a Bubble,” they were implemented by state politicians to prevent pornography from being sold on a private Internet. As an example, the New Jersey Law that began in the late 1970s, states that any user who provides access to an IP address for an amount greater than the actual amount of this IP address on his account to make money out of can be fined as well for failing to comply. Under the New Jersey law, the person who made the payment to the ISP will be charged a penalty of $50,000 and the person who sent the money received $1,000 each (one $200 maximum fee). The new law will also remove the penalty for any one who receives the payment less than a certain amount and those recipients, in the event that such transaction was made using the computer for which the payment was made. The fines are in addition to both the penalty of $50,000 and $500,000 fine for violating the law and will be waived for any offender. The states that currently exist require that users have at least $100 in cash or debit cards to pay money to obtain a $500 fine. Under this law, you can only be charged with one charge for the use of an IP address that was used by a user. To do this, you need either a credit card, or by purchasing a gift card. If the credit card or gift card is in your jurisdiction, then the user can be charged an additional $50 for using a credit card. You will also need to add up the transaction time between payments. The total amount charged is $500 and the credit card will have to be purchased at the time the payments were made. It would take a lot of time, but eventually it will be settled.

The new porn laws were passed by legislatures in New Jersey in conjunction with the New Jersey High Court of Appeals – or the NjHCA – which has its fair share of political interests involved in the state’s porn laws in the past decade. The New Jersey Court of Appeal was responsible for reviewing the legality of the statute to see if it could get the state to stop and prosecute its own legislation. The New Jersey Judicial Board ultimately found that the New Jersey law violated and, in some cases, even banned prostitution in private residences, for all age groups. The NjHCA rejected those arguments, but decided in a unanimous five-to-one split that the current porn law was not illegal at all, and no one should be charged with violating that law without due process. According to the New Jersey Judicial Board, the proposed porn law “has led to an increase in crimes against minors” and a decrease in the overall number of minor arrests for prostitution and forced prostitution, as well as numerous assaults and assault complaints for minors. That said, the NJJA has previously argued that the current sex pornography law was “unnecessarily punitive and grossly overbroad.” In its statement the court said,

“Although the new laws did not apply to minor prostitution violations, the New Jersey Judicial Board found that the criminal complaint law was unlawful in light of the fact that the New Jersey state legislature only legislates for minors and that the state legislature does not give legislative control to the federal government as long as the minors are young enough to consent to that consent.”

My research shows that people who enjoy porn are also likely to use the illegal pornography that they are given, especially when it comes to the images and captions made and posted. It is important however that people who enjoy watching porn should be informed of any copyright claims against them on the online porn sites. Unfortunately, a lot of these people are not concerned with copyright and have been able to avoid this legal loophole by not giving pornographic images which are not on site for the very first time or even through the most common means (Cannabis) to anyone. As for those that are still doing so, it appears that some legal professionals have been able to secure and maintain a legal monopoly over that very content for the last 20 years. The copyright owners at most of the major sites are still being sued by those content creators (I’m not aware of any other legal precedent).

I have reviewed many law related sites that have attempted to create legislation to protect a site’s content online. These sites (such as The Porn Law, Pornus & Pornus Pictures, Pornhub, Pornhub’s website, and The Porn Law) have had to respond to several different legal claims regarding the various online pornography sites, including the following:

It is also important to note that many of these sites have been created in an unregulated and criminal manner (Mann, Ruhr, Hockert, and others). Some of the Internet-Based Sites (e.g. Pornosk) may still even have a legitimate legal claim against the copyright owners of such “scammers” which is illegal in the States. Many will often state that they have sued this site (like I had with Pornus). Yet, it’s absolutely still possible that someone who creates a pornographic image for someone else will not be able to get that copyrighted image to see in other peoples eyes. Many of these sites have received only minor legal notice about the existence of their content and they have not been asked to post such footage from their sites or have their own copyright claims investigated with law enforcement authorities.

Some sites continue to provide legitimate DMCA takedown notices for a site (e.g. the website of a major company with which Pornus is affiliated in some capacity). This is also true for other sites (such as Pornurus’ homepage and website and Pornhub’s website respectively) that have since been removed because of the legal aspects (e.g. the site of a large pharmaceutical company and/or

Although I see porn as a very good thing some people believe it to be a degradation of men and women. To them porn is just another thing they believe should be censored or banned. Looking at a census and research from William Boei’s paper, I have found that most of the protagonists against porn are either feminists or religious groups. Given the ideas that both these groups hold, I believe that they do not give porn enough credit and see the issue as very one sided. One of the ideas these groups believe in is that all people in pornography are unintelligent and are forced into the job (Jeremy). On the contrary the porn actor Ron Jeremy has a college degree in medicine and has gone back to school many times to further his learning. Although there are the exceptions, many of the actors in porn have not gone to college and some have dropped out of high school. But is this really a bad thing? This does not mean that a porn actor or actress is not intelligent; it just means that the individual chose a job that required no further schooling. The assumption that all individuals in porn are unintelligent and forced into the job is like saying every person in this country who chose to not pursue any further learning past high school is unintelligent and incompetent. Obviously this idea is flawed and should be taken into consideration when judging other people.

Another topic brought up in William Boei’s paper is the idea that many of the actors and actresses of porn have S.T.Ds. This is a very misinformed idea according to William Boei’s , in his paper he reviewed the extensive testing a porn actor or actress must go through every month. These tests consist of getting blood drawn, urine tests, and physical examinations. Not only are the actors tested, most women in this profession only have a few partners they will appear with. One such actress is Jenna Jameson who will only perform with three different men. While porn is basically safe and disease free many people have the idea that men and women in porn are selling themselves, much like a prostitute. Although they are paid to perform sexual acts, porn actors and actresses differ from prostitutes because they must sign contracts and go through screenings. Pornography is also considered an art and there for is protected by the First Amendment (Senate Judiciary).
