Ethical issues are a growing concern among major corporations today. Balancing corporate policy, law and consumers can become difficult when working with countries that have a different set of rules, regulations, policies and moral standards. The human resource strategy problem that will be explored in this paper is the need for seasonal employees who may be from another country. Employment laws for the state of Georgia will be discussed in solving this issue. “Employment law consists in the body of laws and rules regulating civil rights and non-union related conduct in the workplace. Civil rights include a workplace free from discrimination and harassment for people who fit into one of the legally protected class” (Goldstein, B., 2012). Conduct law refers to equal and fair pay immigrant and employment at will laws. There are federal, state and local laws as well.
Ethical issues are a major concern in organization, because it can ruin a good working and profitable working partnership with other organization or clientele. Other concerns they have are being knowledgeable about the laws, states, federal and city. If not, they can be open for lawsuits. Having unethical business practices will come to light and people will realize that the company and its employees can no longer be trusted. The services the organization provided will be seen or known as unreliable. Unethical behavior will eventually isolate the particular corporation from the community. Criminal acts of securities fraud, conspiracy, insider trading, and falsifying business records have become very highly publicized. Executives from corporations that commit these crimes are held accountable at a high standard. When someone leaders of organizations see this, it becomes a major concern to be ethical or unethical.
Individual influences are influences that can impact ethical behavior, internal and external. In any given organization, there are ethical codes verbal and nonverbal. Stealing someones lunch out of the companys shard refrigerator would be considered a nonverbal ethical code. This silent code can deter one from this unethical action. That is just something you just dont do. The culture of the organization is another influence that can impact ethical behavior. If the leadership is following the codes of conduct established for the company, the employees will follow suit. It makes a difference when leadership is seen following the ethic code of conducts. The size of the organization as well as the way the organizational is structured will also have an influential impact on ethical behavior. Perceived pressure for results will definitely influence ones ethical behavior. Trying to meet deadlines or impressing a manager, these are just a few impacts this can cause. Corporate strategy is another influence that can impact ethical behavior.
“The Migrant and Seasonal Agricultural Worker Protection Act (MSPA) provides employment-related protection to migrant and seasonal agricultural workers and is administrated and enforced by the wage and hour division of the U.S. Department of Labor. Every non-exempt farm labor contractor, agricultural and seasonal agricultural association must; disclose the terms and conditions of employment to each migrant worker in writing at the time of recruitment and to each seasonal worker when employment is offered, in writing if requested” (dol.gov/compliance/guide.com. 2012, p.2.). The worksite must post information about worker protection and pay each worker the wages owed when due and provide each with an itemized statement of earnings and deductions. As stated in the employment law guide, “MSPA must ensure that housing, if provided, complies with substantive federal and state and health standards . If transportation is provided vehicles must meet applicable federal and safety standards and insurance requirements and that each driver be properly licensed” (dol.gov/compliance/guide.com, 2012, p.2).
