Sexual harassment is defined as an attempt to influence, dominate or injure an individual or a class of individuals through sexually inflicted or sexually charged behaviour which tends to create hostile or offensive environment .It may embrace any sexually motivated behaviour considered offensive by the recipient. According to Indian constitution sexual harassment infringes the fundamental right of a woman to gender equality under article 14 of Constitution of India and her right to life with dignity under article 21 of the Constitution.
The author in the present research paper has tried to focus on sexual harassment at workplace and how it is a tortuous liability. It deals with various sexual harassment cases especially Vishakha vs. State of Rajasthan and the decisions thereon and what effect it is having on development of sexual harassment law in India like prohibition of sexual harassment of women at workplace bill 2010. The author has tried to elucidate the remarkable judicial incentives to curb the menace of sexual harassment in our country. It further emphasizes on the need for a tough sexual harassment act which provide stringent punishment for its perpetrators so that the nation moves towards its dream of an egalitarian society.
The project deals with the subject in five parts. The project starts off with introducing what exactly we mean by sexual harassment and what are the various types of sexual harassment.It proceeds to explain sexual harassment at workplace and its effect on victims and organisation and the role of employer in creating a harassment free workplace. It further elucidate on Indian scenario of Sexual Harassment and how it is a tortuous liability.The project ends with Supreme Court judgment on Vishakha vs. State of Rajasthan which is accompanied by guidelines and norms laid down by it and the prohibition of sexual harassment bill.
